Richard D'Onofrio and Mark Taliercio pocketed some of the payments made to their business, KRDM Flooring, of Brooklyn, said prosecutors. Richard D'Onofrio and Mark Taliercio pleaded guilty last fall to fraud conspiracy Two Staten Islanders, who tried to beat the government out of hefty income taxes owed by their Brooklyn business, have been ordered to fork over more than $606,000. Richard D'Onofrio and Mark Taliercio have also been sentenced to five years' probation, avoiding jail.Last fall, the defendants, who own KRDM Floor Covering Inc. in Brooklyn's Brownsville section, pleaded guilty to fraud conspiracy, according to online Brooklyn federal court records.Prosecutors said D'Onofrio and Taliercio diverted payments to KRDM for flooring materials.Instead of depositing those checks in the business' bank accounts, they cashed them at check-cashing shops, without reporting the money as gross receipts. They cashed more than $5 million in checks over the course of the scheme, said the office of Loretta E. Lynch, U.S. attorney for the Eastern District of New York.D'Onofrio, 52, of Castleton Cornes, and Taliercio, 50, of New Dorp, allegedly pocketed some of the money, and also paid some workers off-the-books.Court filings said the duo understated the wages paid to their employees, along with the company's gross receipts, to avoid paying the appropriate FICA taxes. Such taxes are imposed on employers and employees to fund Social Security and Medicare.The business reported more than $1.6 million in combined gross receipts for the 2005 through 2007 tax years, court records said.The defendants paid just over $91,600 in FICA taxes on their business for the years 2005 through 2008, short-changing the government more than $606,000, court papers said.The company was incorporated in March 1991 and is currently active, show online records of the New York Department of State. The lawyer representing D'Onofrio and could not immediately be reached Monday for comment.

STATEN ISLAND, N.Y. -- A recent trial in state Supreme Court, St. George, resulted in a murder conviction and a melee.Now, two siblings and the girlfriend of killer Tyrell Smith potentially face prison time of their own after being indicted on felony assault and other charges stemming from the March 27 brawl.Smith's sister, Tyquasia Smith, 23; his brother, Todd Henderson, 20, and his girlfriend, Tequanna Tyson, 24, are slated to be arraigned Thursday in state Supreme Court, according to online court records.The trio allegedly tried to help Tyrell Smith escape after the Brooklyn resident was convicted of second-degree murder and criminal weapon possession in the Sept. 9, 2012, shooting death of Daequan Wilson, 20, in West Brighton. Additional charges could be unsealed at the arraignment.Ms. Smith and Ms. Tyson are each free on $100,000 bond, records show, while Henderson is being held in lieu of that amount.Ms. Tyson's lawyer, Craig Newman, declined comment on the allegations. Ms. Smith's and Henderson's lawyers could not immediately be reached Monday for comment.Tyrell Smith is being held without bail as he awaits his sentencing on Friday. He faces up to 25 years to life in prison.His lawyer said he will appeal the verdict.
